Welcome to ARStreetArt! These Terms and Conditions (“Terms”) govern your use of our services, including showcasing augmented reality artworks in urban landscapes, collaborating with digital mural artists, selling artworks through our online store, and participating in public competitions. By accessing or using our services, you agree to comply with and be bound by these Terms.

1. Definitions
  •  “ARStreetArt” refers to our platform, services, website, and associated digital tools.
  • “User” or “You” refers to individuals who visit our platform, purchase products, or participate in competitions.
  • “Collaborating Artists” refers to independent creators who work with ARStreetArt to list and sell their artwork on our platform.
  • “Augmented Reality (AR)” refers to the enhanced visual experiences through AR technology that overlay digital elements onto real-world environments.

2. Use of Services
  • Users must be 18 years of age or older to use our services or participate in competitions.
  • All artworks displayed through ARStreetArt are for personal and non-commercial enjoyment unless explicitly stated otherwise.
  • Access to AR experiences and competitions may require specific device compatibility and internet access, for which ARStreetArt bears no responsibility.

3. Collaborations and Licensing
  • Collaborating Artists must ensure that all submitted artworks are original creations and do not infringe on the rights of any third parties.
  • By collaborating with ARStreetArt, artists grant us a worldwide, non-exclusive, royalty-free license to display, promote, sell, and distribute their artworks through our platform.
  • Artists retain copyright ownership of their works but agree to allow ARStreetArt to modify or adapt their artworks as necessary for display in augmented reality formats.

4. Online Store
  • Artworks sold through the ARStreetArt online store are physical or digital representations of the original artworks.
  • We strive to ensure accurate representations of all artworks; however, colours and details may vary depending on the display device used. ARStreetArt is not liable for perceived discrepancies.
  • By placing an order, you agree to provide accurate payment and shipping information.

5. Shipping and Delivery
  • We aim to process and dispatch our made to order items within 1-2 week’s of purchase.
  • Delivery times are subject to carrier policies and may vary based on location.
  • ARStreetArt is not responsible for delays caused by customs, natural disasters, or other external factors beyond our control.
  • Shipping fees, taxes, and import duties (if applicable) are the responsibility of the customer and will be disclosed during checkout.

6. Refunds and Returns
  • Returns are accepted within 14 day’s of delivery, provided the artwork is in its original condition.
  • Refunds will be processed once the returned item is received and inspected.
  • Digital artworks are non-refundable unless there is a demonstrable issue with the file quality or delivery.

7. Public Competitions
  • ARStreetArt may host public competitions, allowing participants to win prizes by engaging with our AR artworks.
  • All competitions are subject to specific rules, which will be made available at the time of the event.
  • ARStreetArt reserves the right to disqualify participants who engage in fraudulent or unethical behavior.

8. Limitation of Liability
  • ARStreetArt provides services “as is” without any warranties, express or implied, including but not limited to fitness for a particular purpose, merchantability, or non-infringement.
  • ARStreetArt is not liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use our platform or services.
  • ARStreetArt Is not responsible for any errors, omissions, or inaccuracies in the content or AR experiences provided through our platform.
  • ARStreetArt disclaims liability for loss of data, interruptions, device compatibility issues, or failure to achieve the desired AR experience.
  • For physical goods sold through the online store, our liability is limited to the value of the purchased item.
  • Users and Collaborating Artists agree to indemnify ARStreetArt against any claims, liabilities, or damages arising from the violation of these Terms.

9. Intellectual Property
  • All content on the ARStreetArt platform, including but not limited to branding, designs, and code, is the intellectual property of ARStreetArt or its licensors.
  • Unauthorised reproduction, distribution, or modification of our content is prohibited.
